The contract established in the event of an effective order within the framework of and according to the terms outlined in the current general conditions of sale, results from the regulations of distance selling, such as they are notably the result of the Consumer Code, as well as the specific measures outlined below.
An order implies the irrevocable adherence to the general conditions of sale. The client claims to have the capacity to conclude the present contract, that is, to have the legal majority and to not be under guardianship or legal guardianship.

The access to and use of www.pat-studio.com, including display of web pages, communication with Provider, downloading product information and making purchases on the web site, are carried out by our users exclusively for personal purposes, which should in no way be connected to any trade, business or professional activity. PAT STUDIO or Provider shall have the right, at any time, to claim the authorship of any Content posted on this Site and to object to any use, distortion or other modification of such Content.

Any reproduction, publication, distribution, display, modification, creation of derivative work from, or exploitation in any way of, the Content expressly authorised in writing by PAT STUDIO or Provider shall be carried out by you for lawful purposes only and in compliance with all applicable laws.

These General Terms and Conditions of Use are governed by Spanish law.

6.1 Regarding the protection of personal data, the provisions of current regulations will be followed and, specifically, the provisions of Regulation (EU) 2016/679, of April 27, 2016, regarding the protection of natural persons, and in Organic Law 3/2018, of December 5, Protection of Personal Data.
The contractual relations between the professional and the client, object of these general conditions of online sale, will be governed by Spanish Law or, failing that, in the European Union.

6.2 For the resolution of all litigious issues arising from the contractual relationships that are the object of these general conditions, the professional and the client submit, expressly waiving any other jurisdiction that may correspond to them, to the exclusive jurisdiction of the Courts of the city of Logroño . However, in the event of breach by the client of any payment obligations, the professional may choose, alternatively, to exercise the legal actions that correspond to him before the Courts of the place where the client’s domicile is located.

Please read these terms and conditions carefully before ordering any products. You should understand that by ordering any of our products, you agree to be bound by these terms and conditions. The products purchased on www.patstudio.com are directly sold by PAT STUDIO company with registered office in Spain at Calle Calvo Sotelo, 28 – Logroño (La Rioja) 26003 under number 16604221S and whose VAT number is ES16604221S

1. Our Business Policy

The Vendor offers products for sale on www.pat-studio.com and its e-commerce business services are available exclusively to its end users, i.e. the “Consumers”.

“Consumer” shall mean any individual who is acting for purposes which are outside his or her trade, business or profession. If you are not a Consumer, please do not buy any products on www.pat-studio.com.

The Vendor reserves the right not to process orders received from users who are not “Consumers” and any other order which does not comply with the Vendor’s business policy.

These General Terms and Conditions of Sale (together with the documents referred to herein) regulate the offer, transmission and acceptance of purchase orders relating to products on www.pat-studio.com between the users of www.pat-studio.com and the Vendor.

The General Terms and Conditions of Sale do not regulate the supply of services or the sale of products performed by third party that are on www.pat-studio.com through links, banners or other hypertext links. Before sending orders and purchasing products and services from those third party, we recommend that you verify the third party’s terms and conditions, since the Vendor shall under no circumstances be deemed liable for the supply of services provided by third party or for the execution of e-commerce transactions between the users of www.pat-studio.com and third party.

2. How to Execute a Contract with the Vendor

To place an order for the purchase of one or more products on www.pat-studio.com, you must fill out the online order form and send it electronically to the Vendor, following the relevant instructions.

The order form contains a summary of these General Terms and Conditions of Sale, information on the main characteristics of each product ordered and corresponding unit price (including all applicable fees and taxes), the type of payment that you may use in order to purchase each product, shipping terms for the purchased products, shipping and delivery costs and the terms and conditions for returning purchased products.

An order shall be deemed to have been submitted when the Vendor receives your order form electronically and the order information has been verified as correct.

2.4
Before submitting your order form for the purchase of products, you will be asked to carefully read and agree the General Terms and Conditions of Sale.

2.5
The order form will be filed in our database for the time required to process your order and as provided by law. You may access your order form by clicking on the section called My Order, in the Customer Service area.

Before submitting the order form, you will be asked to identify and correct possible input errors.

2.7
English is the language used for executing contracts with the Vendor.

2.8
After your order form has been submitted, the Vendor will process your order.

2.9
The Vendor may not process purchases when there are not sufficient guarantees of solvency, when orders are incomplete or incorrect, or the products are no longer available. In the above cases, we shall inform you by email that the contract has not been executed and that the Vendor has not carried out your purchase order specifying the reasons thereof.

2.10
By submitting an order form to and making a contract with the Vendor, you unconditionally accept and undertake to observe the provisions of these General Terms and Conditions of Sale. Should you not agree with certain provisions of these General Terms and Conditions of Sale, please do not submit your order form for the purchase of products on www.pat-studio.com.

By submitting an order form, you agree and accept these General Terms and Conditions of Sale as well as further conditions contained on www.pat-studio.com including the General Terms and Conditions of Use and Privacy Policy.

Upon submission of an order form, the Vendor shall send you a purchase order receipt email, containing a summary of the information related to the order form (General Terms and Conditions of Sale, the products’ main characteristics, detailed information on the price, terms of payment, return policy and shipping costs).

3. Product Price Indication

3.1
On www.pat-studio.com, we only offer products marked with the “PAT STUDIO” trademark.

3.2
The Vendor does not sell second-hand products, flawed products or products of lower quality than the corresponding market standards.

3.3
The main characteristics of products are shown on www.pat-studio.com on each product page. The products offered for sale on www.pat-studio.com may not exactly correspond to the real garments in terms of image and colours due to the Internet browser or monitor used.

3.4
Prices are subject to change without notice and will be as quoted on our site from time to time, except in cases of obvious error. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
Check the final price of sale before sending the relevant order form.

3.5
Orders made from a Country site different from the one you are shipping to, or to addresses to which the Vendor cannot ship, will be automatically cancelled.

3.6
All Products sold by www.pat-studio.com come with an identification tag attached with a disposable seal. When trying on the products you should not remove or alter the tag or seal from the purchased products should you wish to return the purchased product.

3.7
The Products are sold within the limits of available stocks. Despite all precautions taken, it is possible that a Product ordered may no longer be available. In such an event, PAT STUDIO shall undertake to inform the Client as soon as possible and, where applicable, to reimburse the Client for the full amount paid using the same means of payment previously used by the Client.

3.8
In the event that you exercise your right of withdrawal, the seller might not to accept the return of products without their respective label, seals, documentation and original packaging, as well as products that have been damaged or as essential characteristics and qualitative have been altered.

3.9
Furthermore, as it concerns hand-crafted creations, the articles may present ‘finishing’ irregularities due to this type of fabrication which cannot be considered to be major defects as they are part of the process.
Regarding to the leathers, these are natural and unique, so any incidental tonal variations, marks or veins are natural features and should not be considered as imperfections.
The responsibility of the seller cannot be called into question, the validity of the order cannot be affected by the above.
In all eventualities, the presentation photos of the products on offer in the electronic catalogue www.pat-studio.com are not contractual, and they cannot make the seller liable to the buyer.

4. Payments

4.1
Payment of the product prices, relevant costs for shipping and delivery must be made by using one of the procedures indicated on the order form.
The payment for purchases can only be made by credit card or bank card.
The buyer will need to transmit his or her bank card number, according to card type, the expiry date of the card, as well as the security number (3 figure number which is at the back of the bank card).
The buyer guarantees to the seller, during the validation of his or her order form, that his or her situation is legal in regard to the payment card issuer.
The financial information will be transmitted, by means of an encryption protocol, to your banks providing services related to electronic distance payments, without third party being able to have access to it.

4.2
In case of payment by Credit/Debit Card, all details (for example, card number or expiration date) will be sent by encrypted protocol to your bank which provide remote electronic payment services, without third party having any access thereto whatsoever. Such details will not be used by the Vendor except for performing the procedure relevant to your purchase or issuing refunds in the case of returns in compliance with the exercise of your return right or for reporting cases of fraud to the police.
The price for the purchase of products and the corresponding costs for shipping and delivery, as indicated in the order form, will be charged to your current account only when the purchased products are actually shipped.

4.3
Failure to reply to the Order confirmation shall constitute express acceptance of the Order and its terms and conditions by the Client. The Company retains the right to refuse any Order in the event of:
(i) Existing or past litigation with the Client
(ii) Total or partial non-payment of a previous Order by the Client
(iii) Refusal to authorise payment by credit card from banking organisations
(iv) A request for an abnormally large quantity of Products for a consumer
Any Order implies an obligation to pay by the Client.
PAT STUDIO shall undertake to honour the validated Orders, within the limits of available stocks.

4.4
PAT STUDIO is likely to organise various promotional operations, including in the form of announcements of price reductions in the context, for example sales or PAT STUDIO days. Price reductions are established in relation to reference prices which generally correspond to the prices offered to current clients outside the reduction period in question.
The promotional codes offered by PAT STUDIO apply only to the base price without discounts. Promotional codes cannot be combined with each other or with vouchers.
Promotional codes may be used once (1) per Client unless otherwise instructed by PAT STUDIO. Products purchased with these codes cannot be exchanged or refunded.

5. Shipping and Delivery of the Products

Please read these sections carefully. The information provided in these sections forms an integral part of these General Terms and Conditions of Sale and, consequently, shall be deemed to be fully read and accepted by you at the time your order form is sent.
The ordered product is delivered by a transporter, depending on the nature of the ordered product, and by the exclusive initiative of the seller, to the address on the order form of the buyer. This address may differ from the address of the person who paid.

Our bags are mainly made in a traditional way ‘by hand’ at our workshops in Ubrique, Spain. Some of our bags are only made by command, so they can be specially made by our workshops at the buyer’s request. The buyer’s attention is therefore drawn to the fact that the delivery times for special orders may vary from 1 to 5 weeks depending on the time of year and the complexity of the works requested.
www.pat-studio.com delivers throughout the European Union and the rest of the world. For all countries outside of the European Union, delivery is made on a DDP basis (Delivery Duty Paid). This means the recipient will not be liable for any local sales taxes or import duties which may be charged on the purchase.
www.pat-studio.com does not deliver PO Boxes.
In the event of damage, it lies with the buyer to verify the contents, the conformity and the state of the product on delivery. This verification should take place once the buyer, or a person duly authorised by the buyer, has signed the delivery order presented by the postmaster or by the transporter.

6. Reception

Delivery shall be made with the Client’s signature, which shall be proof of the proper receipt of the Products.
The transfer of risks and liability relating to the Products shall take place upon receipt of the Products by the Client. From this date, the Client shall be solely and exclusively responsible for them, their use and any consequences that may result from their use.
Consequently, the Client undertakes to check, at the time of delivery, that the Order delivered is complete, conforming and has not been damaged. Any anomaly/reservation identified at the time of delivery (in particular late delivery, missing or damaged product) must be fully and accurately reported by the Client on the carrier’s receipt upon delivery of the Products and/or confirmed by registered letter to the curier within fourteen calendar (14) days of receipt of the delivery.
Any Order delivered with the Client’s signature shall be deemed to be compliant, complete and in perfect condition at the time of delivery and in the absence of such a report.
Any apparent anomaly concerning an Order (number of units, condition of the packaging, etc.) must be indicated precisely (detailed description of the anomaly) by the Client on the carrier’s delivery slip, in the presence of the carrier.
The Client must immediately inform PAT STUDIO by providing any useful evidence (photograph, description of the anomaly, etc.). An apparent anomaly means any anomaly that should normally be detected by a normally attentive and informed consumer. Absent any notification, the Products shall be deemed to have been delivered free of any apparent anomaly.
It is therefore up to the Client to preserve his rights vis-à-vis the carrier.

7.- Consumer Rights and the Cooling-Off Period

7.1 Returns Policy

Our purpose is to guarantee your full satisfaction. If, for any reason whatsoever, you are not satisfied with your order, you may exercise your right to cancel your purchase and return purchased products. Our customer service will give you all the information you may need. We also suggest you precisely note measurements and scale of all products before purchasing in that way we also contribute reducing footprint and unwanted taxes.
You must inform the Vendor of your decision to cancel and can do so by emailing customer@pat-studio.com contacting us within fourteen (14) calendar days from the date of delivery. These must be returned by dispatching the package through the shipping agent indicated by the Vendor (DHL) that might provide with a tracking number.

7.2 Terms and Conditions of Return

The right to return products shall be deemed correctly exercised once the following conditions have been fully met:

the products have not been used, worn, washed or modified and, in any case, compliant with the requirements detailed in the section on Compliance Checks below.
the identification tag is still attached to the products with the disposable seal.
the products are returned in their original packaging; accompanied by their documentation, labels, seals and protective bag.
the returned items must be shipped back to the Vendor within fourteen (14) calendar days from the date of delivery.
the products should not be damaged.
products which are made to your specifications or clearly personalized will not be accepted.

Returns that do not comply with these regulations will not be accepted under any circumstances.
Please note that all orders that are sent from out of the EU may incur duty and taxes which are to be paid by the Client.
For international orders, if an item is returned because a customer refused to pay for any import taxes or customs duties due payable, PAT STUDIO will seek to recover from the customer all costs or any fees incurred by PAT STUDIO. Please note that if you refuse to pay custom duties upon delivery, a refund will only be issued after the product has been returned to us.
All parcels must be sent via tracked post through DHL. Please be aware that original shipping costs, duties and taxes are non–refundable, and they will be deducted from your refund for any international return.
Fill out 3 copies of the Returns Proforma Invoice that came with your parcel. Please note that these forms are required for customs clearance and that any duties, taxes and fees you have paid for the delivery of the purchased products shall not be refunded. Please visit our Customer Care area where you will find information on customs.

7.3 Compliance Checks

Our products must be returned in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them, including all accessories and documents. We reserve our right not to accept any return if the product shows signs of wear, or has been used or altered from its original condition in any way or, as an alternative, may reduce the amount of any applicable refund or exchange accordingly.
For example, we may make a reduction in the following circumstance:
You have not returned any packaging which is an integral part of a product (such as a dust bag or its original box). Please note that this constitutes an integral part of each product and its lack decreases the value of the returned products.

You will be informed if we propose to reduce your refund for this reason. In this instance, you may (as an alternative to us providing you with a reduced refund) choose to have the products sent back to you at your own expense. Should you refuse this delivery, PAT STUDIO reserves the right to retain the products and the amount indicated for the decrease in refund.
Before sending your product please email us to customer@pat-studio.com asking for a Return Authorization code and carefully read and follow our conditions about how to return items. Please do not ship your return back without a return authorization. It will not be processed.
Customer service can request photographic support regarding defective or incorrect merchandise before authorising a return. Unauthorised returns from our customer care team will not be accepted.
Returned Products must imperatively be accompanied by all their accessories, documents, seals, its purchase invoice, and in their original undamaged packaging with the return form issued by PAT STUDIO by email, perfectly protected and sent by post, at the Client’s risk and peril, to the following address:

All parcels must be sent via tracked post through DHL. Please be aware that original shipping costs, duties and taxes are non–refundable, and they will be deducted from your refund for any international return.
If your order was placed within the EU, all sales taxes will be refunded.
For International orders, shipping, customs duties and sales taxes are non-refundable through PAT STUDIO.
For international orders, if an item is returned because a customer refused to pay for any import taxes or customs duties due payable, PAT STUDIO will seek to recover from the customer all costs or any fees incurred by PAT STUDIO. Please note that if you refuse to pay custom duties upon delivery, a refund will only be issued after the product has been returned to us.
The return and financial responsibility is yours until it reaches to PAT STUDIO.

8. Refund Times and Procedures

8.1
After the Vendor has received the returned products and checked that the products meet all requirements, you will receive an email that the returned products have been accepted.

8.2
We will refund any money received from you using the same method originally used by you to pay for the purchase whatever the form of payment you used (Credit/Debit Card) within thirty (30) days, as long as the products all the above requirements have been fulfilled. The period of time necessary to carry out the payment of the refund or the restitution of the sums you have paid to acquire the products, depends on the forms of payment used:

credit or debit card: the speed of the refund depends on the entity that issued the credit or debit card used

8.3
If the recipient of the products indicated in the order form is different from the individual who made the payment for such products, the amount paid for returned items shall be refunded by the Vendor to the individual who made the payment.

8.4
The Vendor will refund the price of the products in accordance with the applicable time frame as specified before. To the extent permitted by applicable law, the Vendor shall not be responsible for any delay that is beyond its control including for delays caused by the method of purchase or refund.

8.5
As advised by the Vendor, returned products may be shipped by the package delivery company DHL, using the label sent by emailing our customer assistance customer@pat-studio.com. Please just contact DHL (or visit their site: www.dhl.com) to organise pick-up.

In case of exercising your right of withdrawal, you must make the payment of the return costs yourself, and you will receive the refund for the entire amount you paid for your purchase. In this case, you will assume all responsibility for any possible loss or damage to the products returned during transport, according to the modalities and terms described in the article dedicated to the Right of Withdrawal.

These General Terms and Conditions of Sale are governed by Spanish law related to e-commerce.

11. Amendments and updates

The General Terms and Conditions of Sale may be amended from time to time due to new laws and regulations or other reasons. The new General Terms and Conditions of Sale shall be effective as of the date of publication on www.pat-studio.com
